This licence authorises the licensee to carry on a financial services business to:
deal in a financial product by:
issuing, applying for, acquiring, varying or disposing of a derivative restricted to the following classes of financial products:
contractual arrangements not entered into on a licensed market or a financial market that is exempt under a declaration made under section 791C of the Corporations Act where a party to the arrangement must, or may be required to provide future consideration and where the amount of the consideration or the value of the arrangement is ultimately determined, derived from or varies by reference to (wholly or in part) the value or amount of (in any nature whatsoever and whether or not deliverable):
the wholesale price of electricity;
the price of Large Scale Generation Certificates registered on the Renewable Energy Register;
the price of Small Scale Technology Certificates registered on the Renewable Energy Register; or
the price of Energy Savings Certificates registered on the Energy Savings Scheme Registry.
where the only purposes of the licensee in entering the arrangements are to:
manage or mitigate the financial consequences of particular circumstances happening; or
avoid or limit the financial consequences of fluctuations in, or in the value of, receipts or costs (including process).
to wholesale clients.
