<strong>Date of Effect:</strong> 27/06/2023<br/><strong>Reason:</strong> 40-5(1)(b) individual no longer meets registration requirements[POPUP_FOR_DETAILS]<br/><strong>Registration requirement not met:</strong> <ul><li>20-5(1)(a) Individual has ceased to meet registration requirement that they are a fit and proper person</li></ul><br/><strong>Explanation:</strong> On 11 May 2023, after completing an investigation, the Tax Practitioners Board (TPB) decided to terminate the BAS agent registration of Mr Damien Luscombe. The TPB determined that Mr Luscombe was no longer eligible for registration as he no longer satisfied the TPB that he was a fit and proper person.<br><br>The TPB also imposed a period of five years during which Mr Luscombe may not apply for registration.<br><br>The TPB determined that Mr Luscombe had ceased to meet the tax practitioner registration requirement that he is a fit and proper person, on the basis that/of:<br>1. Mr Luscombe acknowledged in his response to the Board that he did not deny that he ceased to meet the registration requirements in the TASA with respect to: <br>a. having not acted with honesty and integrity<br>b. having not acted lawfully in the best interests of his clients<br>c. not being a fit and proper person<br>2. the seriousness of the conduct<br>3. on 10 May 2023, Mr Luscombe had been formally charged with 11 counts of obtaining a financial advantage by deception and 11 counts of making and using a false document under sections 82 and 83 of the Victorian Crimes Act 1958, in relation to the conduct<br>4. Mr Luscombe’s own proposal that the Board terminate his registration and that he would accept a five-year period during which he was unable to reapply for registration.<br>
