<strong>Date of Effect:</strong> 30/06/2023<br/><strong>Reason:</strong> 40-15(1)(b) company no longer meets registration requirements[POPUP_FOR_DETAILS]<br/><strong>Registration requirement not met:</strong> <ul><li>20-5(3)(a) Company has ceased to meet registration requirement that each director is a fit and proper person</li></ul><br/><strong>Explanation:</strong> On 11 May 2023, the Tax Practitioners Board (TPB) decided to terminate the tax agent registration of Arbitrans Accounting Pty Ltd (the Company) as it ceased to meet the tax practitioner registration requirement in the Tax Agent Services Act 2009 (TASA) that each director of the Company must be a fit and proper person.<br><br>The TPB concluded that the Company’s sole director, Mr Trevor McTaggart, was no longer a fit and proper person on the basis that:<br>• he had held the status of an undischarged bankrupt three times since December 2000.<br>• the Supreme Court of Victoria made findings and observations about him that were detrimental to his fame, integrity and character.<br>• an Australian Taxation Office (ATO) audit found that he had failed to report over $800,000 of personal income between the 2009 and 2013 financial years, resulting in a substantial tax shortfall and associated penalties.<br>• he was disciplined by the Institute of Public Accountants in 2015, whilst he was a member of that association, for using unprofessional language and making unfounded allegations in correspondence with another party.<br>• he was convicted in 2019 of two counts of using a forged document in connection with obtaining a benefit from the ATO on behalf of a business associate.<br>• he used unprofessional and offensive language on numerous occasions in correspondence with two clients of the Company.<br>• he failed to lodge numerous income tax returns and business activity statements for himself and his related entities over a period of three years.<br><br>Taking into account the above matters, the TPB also determined that the Company should be prohibited from applying for registration under the TASA for a period of five years from the date the termination of its registration takes effect.<br><br>In making its decision, the TPB noted its role is to ensure consumer protection and that it has an objective to protect and maintain the integrity of the registered tax practitioner profession.<br><br>The TPB also considered the seriousness of Mr McTaggart’s conduct and the fact that the conduct formed an ongoing pattern of behaviour over a prolonged period. The TPB determined that it could not have confidence that the practice would continue to operate without the influence of Mr McTaggart if it were allowed to remain registered.
